1. General Terms

1.1. Punguzo offers discounted products from various merchants to users.

1.2. Our head office is located at Block 54 - Mikocheni B, CocaCola Road, Dar es Salaam, Tanzania.

2. Eligibility

2.1. You must be at least 18 years old to use Punguzo.

2.2. By using Punguzo, you represent and warrant that you have the legal capacity to enter these Terms.

3. Account Registration

3.1. You may need to create an account to use certain features of Punguzo.

3.2. You agree to provide accurate and complete information during the registration process.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of Punguzo

4.1. Punguzo allows you to browse and purchase discounted products from participating merchants.

4.2. You agree to use Punguzo only for lawful purposes and in accordance with these Terms.

4.3. You shall not use Punguzo for any illegal, fraudulent, or unauthorized purposes.

5. Transactions

5.1. All transactions made through Punguzo are between you and the respective merchant.

5.2. PGI is responsible to mediate any issues arising from transactions, including but not limited to product quality, delivery, or refunds.

5.3. Payment for products is processed through M-Pesa, and you agree to comply with M-Pesa's terms and conditions.

6. Discounts and Promotions

6.1. Discounts and promotions offered on Punguzo are subject to change without notice.

6.2. Merchants are responsible for honoring discounts and promotions as advertised on Punguzo.

7. Privacy

7.1. We respect your privacy and are committed to protecting your personal data. Please refer to our Privacy Policy for more information on how we collect, use, and protect your information.

8. Intellectual Property

8.1. All content and materials available on Punguzo, including but not limited to text, graphics, logos, and software, are the property of PGI or its licensors and are protected by applicable intellectual property laws.

8.2. You may not use, reproduce, distribute, or create derivative works from any content on Punguzo without our prior written consent.

9. Termination

9.1. We may terminate or suspend your access to Punguzo at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

9.2. Upon termination, your right to use Punguzo will immediately cease.

10. Limitation of Liability

10.1. To the fullest extent permitted by law, PGI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use Punguzo; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from Punguzo; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through Punguzo by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through Punguzo.

11. Indemnification

11.1. You agree to indemnify and hold harmless PGI, its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of Punguzo, or your violation of these Terms.

12. Governing Law

12.1. These Terms shall be governed by and construed in accordance with the laws of Tanzania, without regard to its conflict of law principles.

12.2. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts located in Dar es Salaam, Tanzania.

13. Changes to Terms

13.1. We reserve the right, at our sole discretion, to modify or replace these Terms at any time.

13.2. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13.3. By continuing to access or use Punguzo after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using Punguzo.
